_module_preset=\u00a0\u00bbdefault\u00a0\u00bb hover_enabled=\u00a0\u00bb0&Prime; sticky_enabled=\u00a0\u00bb0&Prime;]<\/p>\n<div class=\"zoneCoulante\">\n<div class=\"editorial\">\n<p><span style=\"color: #000000;\">Le Code du travail introduit une distinction entre l\u2019IPRP\u00a0:<\/span><\/p>\n<ul style=\"margin-bottom: 0px;\">\n<li><span style=\"color: #000000;\">employ\u00e9 par le service de sant\u00e9 au travail<\/span><\/li>\n<li><span style=\"color: #000000;\">externe auquel l\u2019employeur et le service de sant\u00e9 au travail font appel pour une mission sp\u00e9cifique.<\/span><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div class=\"clearAll\"><\/div>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00a0\u00bb4.7.3&Prime; _module_preset=\u00a0\u00bbdefault\u00a0\u00bb hover_enabled=\u00a0\u00bb0&Prime; sticky_enabled=\u00a0\u00bb0&Prime;]<\/p>\n<h3>L\u2019<span class=\"definition tooltipParent tooltipstered\">IPRP<\/span> externe\u00a0: prestataire de services<\/h3>\n<p> Lorsque l\u2019employeur ne dispose pas de salari\u00e9s comp\u00e9tents pour s\u2019occuper des activit\u00e9s de protection et de pr\u00e9vention des risques professionnels ou lorsque le service de sant\u00e9 au travail ne dispose pas des comp\u00e9tences techniques n\u00e9cessaires \u00e0 son intervention, l\u2019un et l\u2019autre peuvent faire appel, le cas \u00e9ch\u00e9ant, \u00e0 un IPRP d\u00fbment enregistr\u00e9 aupr\u00e8s de la <span class=\"definition tooltipParent tooltipstered\">DIRECCTE<\/span>.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column _builder_version=\u00a0\u00bb4.7.3&Prime; _module_preset=\u00a0\u00bbdefault\u00a0\u00bb type=\u00a0\u00bb1_3&Prime;][et_pb_text _builder_version=\u00a0\u00bb4.7.3&Prime; _module_preset=\u00a0\u00bbdefault\u00a0\u00bb hover_enabled=\u00a0\u00bb0&Prime; sticky_enabled=\u00a0\u00bb0&Prime;]<\/p>\n<h3>Droit d\u2019acc\u00e8s de l\u2019IPRP aux documents aff\u00e9rents \u00e0 la sant\u00e9 et \u00e0 la s\u00e9curit\u00e9 au travail<\/h3>\n<p style=\"margin-bottom: 0px;\">L&rsquo;IPRP enregistr\u00e9 a acc\u00e8s \u00e0 tous les documents non nominatifs rendus obligatoires par la partie 4 du\u00a0 Code du travail en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 au travail. Ce droit d&rsquo;acc\u00e8s s&rsquo;exerce dans des conditions garantissant le caract\u00e8re confidentiel des donn\u00e9es ainsi que la protection des informations mentionn\u00e9es \u00e0 l&rsquo;article R. 4624-9 du Code du travail. Il est en effet interdit \u00e0 l\u2019IPRP de r\u00e9v\u00e9ler les secrets de fabrication et les proc\u00e9d\u00e9s d&rsquo;exploitation dont il pourrait prendre connaissance dans l&rsquo;exercice de ses fonctions. La m\u00e9connaissance de ces interdictions est punie conform\u00e9ment \u00e0 l&rsquo;article 226-13 du Code p\u00e9nal.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column _builder_version=\u00a0\u00bb4.7.3&Prime; _module_preset=\u00a0\u00bbdefault\u00a0\u00bb type=\u00a0\u00bb1_3&Prime;][et_pb_text _builder_version=\u00a0\u00bb4.7.3&Prime; _module_preset=\u00a0\u00bbdefault\u00a0\u00bb hover_enabled=\u00a0\u00bb0&Prime; sticky_enabled=\u00a0\u00bb0&Prime;]<\/p>\n<h3>Modalit\u00e9s d\u2019intervention de l\u2019IPRP<\/h3>\n<p>L\u2019IPRP intervient dans un cadre contractuel d\u00e9fini dans une entreprise\u00a0:<\/p>\n<ul>\n<li>soit parce que l\u2019employeur fait directement appel \u00e0 lui dans le cadre d\u00e9fini de l\u2019article L. 4644-1 du Code du travail, notamment si les comp\u00e9tences dans l&rsquo;entreprise ne permettent pas d&rsquo;organiser ces activit\u00e9s de protection et de pr\u00e9vention des risques professionnels<\/li>\n<li>soit dans le cadre d\u2019une prestation de service pour un service de sant\u00e9 de travail interentreprises en raison de comp\u00e9tences dont le service ne dispose pas (art. 4623-39 du Code du travail).<\/li>\n<\/ul>\n<p>L&rsquo;IPRP d\u00fbment enregistr\u00e9 est contractuellement li\u00e9 par la conclusion d&rsquo;une convention entre celui-ci et l&#8217;employeur ou le pr\u00e9sident du service de sant\u00e9 au travail interentreprises.<\/p>\n<p>Cette convention pr\u00e9cise\u00a0:<\/p>\n<ul>\n<li>Les activit\u00e9s confi\u00e9es \u00e0 l&rsquo;IPRP ainsi que les modalit\u00e9s de leur exercice.<\/li>\n<li>Les moyens mis \u00e0 la disposition de l&rsquo;IPRP ainsi que les r\u00e8gles d\u00e9finissant son acc\u00e8s aux lieux de travail et l&rsquo;accomplissement de ses missions, notamment la pr\u00e9sentation de ses propositions, dans des conditions assurant son ind\u00e9pendance.<\/li>\n<\/ul>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=\u00a0\u00bb4.7.3&Prime;
